1. Agreement

These terms are an agreement between you, the property owner or manager ("you"), and AmeniSync ("AmeniSync," "we"). By creating an account, buying a kit, or using the service, you agree to them. If you use AmeniSync for a business, you confirm you can bind that business.

2. What AmeniSync does

AmeniSync is software and a small network device that connects to your existing Pentair ScreenLogic pool system, your OwnerRez account, and Stripe. It lets guests buy pool heating and schedules your existing equipment for those dates.

AmeniSync does not make, install, inspect, repair, or maintain pool equipment. You remain responsible for your pool, heater, pumps, electrical, plumbing, and network, and for following the manufacturer's instructions and local laws.

3. Your equipment and your responsibilities

You confirm you own or are authorized to control the pool system and network you connect. You will keep your equipment in safe working order, have it serviced by qualified professionals, and keep manufacturer safety limits and shut-offs in place.

You are responsible for pool safety, water chemistry, fencing, covers, signage, supervision rules, and guest use of the pool. You will not rely on AmeniSync as a safety, freeze-protection, leak, or alarm system.

Internet, power, router, ScreenLogic, OwnerRez, or Stripe outages can stop the service from working. Heating may not start, stop, or reach a target on time.

4. Indemnification and release for equipment damage

To the fullest extent the law allows, you release AmeniSync, its owners, employees, and contractors from, and agree to indemnify, defend, and hold them harmless against, any claim, loss, damage, cost, or expense (including reasonable legal fees) arising from or related to: damage to, wear of, or failure of your pool, heater, pump, controller, ScreenLogic hub, plumbing, electrical system, router, or any other property; energy, gas, or utility costs; injury or illness of any person using or near the pool; your guests' acts; your breach of these terms; or your use of the service.

This applies whether the damage happens while AmeniSync is running a schedule, after a command, or because a command did not run.

5. No warranty

The service and kit are provided "as is" and "as available." To the fullest extent the law allows, AmeniSync disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted, error-free, secure, or will reach any temperature.

6. Limitation of liability

To the fullest extent the law allows, AmeniSync is not liable for indirect, incidental, special, consequential, or punitive damages, lost bookings, lost revenue, or property damage. AmeniSync's total liability for any claim is limited to the AmeniSync fees you paid in the 3 months before the claim.

7. Third-party services

Pentair, OwnerRez, and Stripe are separate companies with their own terms. AmeniSync is not responsible for their products, outages, changes, fees, or decisions, including Stripe account reviews, holds, or payout delays.

8. Accounts, access and security

Keep your password private. You are responsible for activity under your account. You authorize AmeniSync to connect to and send commands to your pool system and to read the reservation details needed to offer pool heat. You can disconnect at any time by unplugging the device and revoking access in OwnerRez.

9. Data and privacy

We collect what the service needs: your account details, property and pricing settings, reservation details passed through guest links, payment records, and device status. We use it to run the service, not to sell it. Card details are handled by Stripe; AmeniSync never sees full card numbers.

10. Payments, fees and payouts

Guests pay for pool heat through Stripe. Stripe charges its own processing fee (roughly 3% per payment). AmeniSync keeps a 5% platform fee. The rest is paid out to the bank account you connect through Stripe, on Stripe's schedule.

Example: a guest pays $100. Stripe takes about $3 and AmeniSync takes $5. You receive about $92.

You set your own prices and are responsible for any taxes due on pool heating you sell, and for telling guests about your own policies.

11. Refunds

Fees are never refundable. The Stripe processing fee and the AmeniSync 5% fee are kept even when a guest is refunded, in full or in part.

Who decides: refunds of guest pool-heat payments are your decision as the owner. A guest asks you; you tell AmeniSync which payment to refund and how much.

How it's processed: AmeniSync issues the refund through Stripe to the guest's original card. The refunded amount is taken from your payout balance. Card issuers usually show it within 5 to 10 business days.

Example: a guest paid $100 and you refund it in full. The guest gets $100 back. The $3 Stripe fee and the $5 AmeniSync fee are not returned, so the refund costs you $100 against the $92 you received — $8 more than your share. A partial refund of $50 is taken from your balance in the same way.

If your Stripe balance can't cover a refund or a chargeback, Stripe may take it from your bank account or future payouts. Chargeback fees charged by Stripe are yours.

Kit and subscription: the monthly service can be cancelled at any time and stops at the end of the paid month; partial months are not refunded. Kit returns are handled case by case. Contact us first.

12. Ending the service

You can stop using AmeniSync at any time. We may suspend or end your access if you break these terms, misuse the service, or if needed for safety or legal reasons. Sections 4, 5, 6, 10 and 11 continue after the service ends.

13. Changes, law and disputes

We may update these terms. We'll show the new date at the top, and using the service after a change means you accept it. If any part is found unenforceable, the rest still applies. These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California.
